Digital Signature - Is it legal?
The Colorado Real Estate Commission indicates that electronic signatures are legitimate if the parties agree to receive an electronic signature. For more information regarding the legality of this process refer to The Colorado Uniform Electronic Transactions Act. A reference to this document is included under General Utilities and can be accessed by clicking on Utilities under either the Main or Detailed Dashboard and clicking on the appropriate link.
Also, initials on every page are not required. For more information, please refer to the Colorado Real Estate Commission Manual. CTMeContracts digital contracts can be signed electronically, or they can be printed and signed with a pen.
Can I really sign with a Mouse or a Font?
Yes, our technology allows you to receive a complete contract, fully populated with transaction data that can be digitally signed with a mouse or font, in much the same way you would sign using a pen. Once a contract has been signed, the real estate agent will receive an email notifying them that the document has been signed using web signatures. Each email will include the type of contract signed, the property address, the name of the signer, and the date and time the document was signed. These documents can be signed without ever printing them or saving them as PDF files.
Option 1: Draw Signature
- Move the cursor in the signature box to draw the signature
- Click Save and the signature will be embedded in that particular contract
- If the signer is not satisfied with the signature, they can click on CLEAR to erase and resign
- Repeat this process in the Initial box next to the signature box if initials are required
- Once the signer clicks Save, a new window will display asking the participant to Accept or Decline the signature
If Accepted the Signature will be embedded in the contract and the contract will be Locked.
Option 2: Sign with a Font
- Click on Select Signature Font below the signature box to create your signature with one of the pre-loaded fonts
- Click Save
- Repeat this process in the Initial box next to the signature box if initials are required
- Once the signer clicks Save, a new window will display asking the participant to Accept or Decline the signature
If Accepted the Signature will be embedded in the contract and the contract will be Locked.
NOTE: It is very important that you let the participants know that after signing they must click Save directly below the signature box below their first name. If they fail to click Save, the signature will not be embedded in the contract. They must also complete the pop-up request to Accept or Decline
IMPORTANT: Participants must complete all THREE STEPS:
- Sign
- Save
- Accept (for the document to be signed and LOCKED)
The DATE stamped next to the signature is the date the contract was signed. The Web Signature system is very similar to the one used in supermarkets, etc. The signature will not be the same as a signature on a piece of paper and participants don`t really care about that, they just want to have a quick and practical transaction.
